Terms and conditions
By placing an order, you accept the contents of these terms and conditions.
Article 1. Applicability
1.1. You can only order on this site if you are over 18 years old.
1.2. On all offers, orders and agreements of Safari Pastel Art/Anne De Weerdt these General Conditions apply. Making an order implies that you accept the applicability of these conditions.
Article 2. Agreement
We accept orders via the website Safari Pastel Art/Anne De Weerdt. After confirmation via email, your order is complete. The general conditions are in force as soon as the confirmation is sent to the e-mail address you provided. The agreement is considered to be concluded in Belgium. However, we reserve the right to refuse to process a particular order for any reason.
Article 3. Products
The pastel paintings/prints on the website are available while stocks last. The website gives an indication of the availability of the works at the time an order is placed. Should the indication say that the works are available and yet turn out not to be, the buyer will be informed of this as soon as possible.
Article 4. Prices and payments
4.1. The prices in the website/webshop for the offered pastel paintings/prints are in Euros (€), including VAT where applicable and excluding shipping costs (€5) for shipments outside Belgium. Shipments in Belgium are free of charge.
4.2. In the event of a price change, the buyer has the right to abandon the purchase.
4.3. Payment is made by bank transfer and the account number will be communicated upon confirmation of the order.
4.4. The goods will be shipped only after payment of the full amount due.
Article 5. Delivery
The stated delivery times are indicative only. Exceeding any delivery period does not entitle you to compensation or the right to cancel your order or dissolve the agreement, unless the exceeding of the delivery period is such that you cannot reasonably be required to maintain the agreement. In that case, you are entitled to cancel the order or dissolve the agreement to the extent necessary.
Article 6. Retention of title
6.1. The ownership of delivered products (pastel paintings and prints) is only transferred when you have paid all that you owe on the basis of any agreement to Safari Pastel Art/Anne De Weerdt. The risk of the products already passes to you at the moment of delivery.
6.2. The delivered products (pastel paintings and prints) may not be reproduced or copied for sale by the buyer/customer.
Article 7. Copyright/Intellectual rights
7.1. The contents of this website, including logos's, pastel paintings/prints, data, texts, images and the like are protected by intellectual rights and belong to Safari Pastel Art/Anne De Weerdt or entitled third parties and can under no circumstances be copied or reproduced.
7.2. The customer/buyer has no right to the design (pastel painting) or the original work file (prints). These remain in the possession and property of Safari Pastel Art/Anne De Weerdt at all times.
Article 8. Claims / Returns
8.1. You have the obligation to check upon delivery that the pastel paintings/prints are not damaged.
8.2. The original pastel paintings are delivered in a frame under glass. The frame with glass is only to protect the work during transport. Damage to the frame/glass we do not refund and is not a reason for complaint.
8.3. If there is damage to the paintings/prints you should notify Safari Pastel Art/Anne De Weerdt as soon as possible and in any case within two working days after delivery, at least after observation was reasonably possible, in writing/per email and motivated. We will then solve it further together.
Article 9. Liability
9.1. Safari Pastel Art/Anne De Weerdt is not liable for misunderstandings in communication when ordering online. The data provided by the buyer/customer imply a commitment for him. In case of mistake in these data Safari Pastel Art/Anne De Weerdt cannot be held liable.
9.2. Our liability is limited to the amount of the purchase. This means that Safari Pastel Art/Anne De Weerdt can never be obliged to accept claims for damages about possible goodwil, loss of profit or any other consequential damage.
9.3. The buyer/customer is himself responsible for the choice of the pastel paintings/prints he orders.
Article 10. Force majeure
In case of force majeure Safari Pastel Art/Anne De Weerdt has the right, at its own choice, to suspend the execution of the order, or to dissolve the agreement without judicial mediation, such by communicating this to you in writing (by email) and such without Safari Pastel Art/Anne De Weerdt being held to any compensation, unless in the given circumstances this would be unacceptable according to standards of reasonableness and fairness. By force majeure is meant every shortcoming which cannot be attributed to Safari Pastel Art/Anne De Weerdt, because it is not due to her fault and neither by virtue of the law, legal act or in the generally accepted notions for her account.
Article 11. Applicable law and competent court
All rights, obligations, offers, orders and agreements to which these Conditions apply, as well as these Conditions, shall be governed exclusively by Belgian law. All disputes between the parties shall be submitted exclusively to the competent court in Belgium for that purpose.
